International Environmental Non-Governmental Organizations And Development Of International Environmental Law: Participation·Innovation·Improvement

Since the Mid-20th century, a large number of environmental issues went into human's vision. Increased acid rain, ozone depletion, the greenhouse effect, soil erosion, grassland degradation, loss of forests and the transboundary movement of waste, destruction of biological diversity......, all of which seriously affect the international economic development and even human survival, the international community urgently need to take effective measures to alleviate the crisis. Global Environmental Management Systems on environmental mitigation based on the close cooperation of the international community plays a major role in alleviating environmental crisis. But with the deepening environmental crisis, the government's failure, the difficulty of international collective action and so on, the traditional mechanism can not meet the needs.The current international environmental law plays an important role in international environmental protection, but its limitations are also high. For example:a number of international environmental legislations are imperfect, inadequate implementation of international environmental law, international Litigation action on environmental damage is blocked...... the rise of international environmental non-governmental organizations can largely improve the shortage of international environmental law. International environmental non-governmental organizations promote the development of international environmental treaties,supervise,coordinate with other international actors on implementation of international environmental law in good faith, when the environment is harmed, they can act as spokesmen in litigation proceedings to safeguard people whose interest is damaged by the environment depletion. In the area of the concept innovation, international environmental non-governmental organizations promote implementation of international environmental justice, promote the democratization of global environmental governance through institutional innovation, thus promote the formation of global environmental civil society within global environmental governance, international environmental non-governmental organizations insert new blood into the global mechanism for public participation to constantly improve the mechanism that can achieve the full advantage of its purpose, they all lay a solid foundation for the international environmental law.International environmental non-governmental organizations has some status in cureent global environmental governance system, but it's personality has not been broadly admitted by international community, its status in international environmental law Subject System is still doubted. From the jurisprudence, civil law and international law point of view, giving the international environmental non-governmental organizations limited law character in international environmental Subject System is essential for the development of international environmental law.States, intergovernmental organizations, transnational corporations are still the core subject in Global Environmental Management Systems. By comparison with traditional subject, the international environmental non-governmental organizations have some voluntary failure, they should not battle lonely and they should strengthen cooperation with other subjects, then global environmental issues and the development of international environmental law will improve.
