The Establishment Of China-Kazakhstan Free Trade Area And Analysis Of Legal Institutions

Today, international economic relations is symbolic of bilateral Free Trade Agreement (FTAS) and multilateral Free Trade Agreement . Multilateral trade agreement has faced the serious challenge of such FTAS.The attitude of World Trade Organization to regionalism is acknowledgement and restriction, but the result of regulation of WTO is not satisfying. That is to say, the rules of WTO which regulate RTAs are not successful. This paper hold the opinion that WTO should accept the reality that WTO and FTAs will coexist for a long time, and WTO should place limited regulations on RTAs. In this background, what is the choice of our country? There is only one principle to make a judgment. That is the interest of china. With guidance of this principle, both multilateralism and regionalism are preference of our country. That is to say, China should develop RTAs in accordance with rules of WTO.China will benefit a lot from China—Kazakhstan Free Trade Area, such as economic interest and geopolitical interest. And this paper also concludes that proper institutions of China—Kazakhstan Free Trade Area are in coincidence with interest of WTO. So this paper draws the conclusion that China—Kazakhstan Free Trade Area should conform to the rules of WTO.According to the analysis mentioned above, there are two problem is to be solve: one is China—Kazakhstan Free Trade Agreement should conform to the rules of WTO, the other is the establishment of institutions of China—Kazakhstan Free Trade Area.
