A Study On The Maiyan Folk Law Of Rongshui Miao Autonomous County In Guangxi

Folk Law is the earliest law with the longest history. However, it exercises profound influence on reality. By reflecting the way that mankind thinks about Nature and the world as well as accumulating the fruits of people's wisdom, folk law stays as the foundation and source of state statutes. As one important part of Chinese law system, folk law of ethnic minority, which still affects ethnic minority areas greatly at the present age, has the most abundant contents and exercises the greatest influence in Chinese law system. Various ethnic minority, along with long period of living and production practices, develop their own national folk laws by which to protect the whole national interests, keep national internal order and to improve the peace and development of national areas.Rongshui Miao autonomous county in Guangxi zhuang autonomous region is the typical assemble area for Miao minority. In there ,a special folk law——Maiyan system has important meaning, By way of expounding the history of the folk Law of Miao Nationality in Rongshui county such as the major content, the history effect and the causes of long-term existence, thesis has analyzed the importance and the profound and lasting influence to the society of Miao by folk Law. This thesis has also inquired into how to balance and harmonize the contradiction between the folk Law of Miao Nationality and the National Formulation Law, how to realize the amalgamation and joint between them, the conflicts and collides between the folk Law of Miao nationality and the current national law take place in the construction of legal system in the area of Miao nationality.The whole thesis includes three parts, they are: forword,text and appendix.In the chapter 1, it expounds the conception and characteristic of folk law, minority folk law and Rongshui Miao minority folk law .In the chapter 2, it expounds the confederation of Maiyan .In the chapter 3 ,it compare the Maiyan system between traditionary and modernize. In the chapter 4。It put forward some methods to face the modernization of folk law in rongshui county.The purpose of this essay is to appeal that we should assimilate nutriment and make use of folk law to help construct our country by rule of law.
