| The practice of governing the county by laws implemented by Weining Yi, Hui and Miao Autonomous County is one part of the practice of governing by law in China. As a minority autonomous county with the largest area in Guizhou Province Weining Yi, Hui and Miao Autonomous County, minority population has higher proportion in the jurisdiction area, the national cultural atmosphere is density and the practice of governing the city by laws is worth exploring. This paper researches from three perspectives including concept, system and practice of governing the city by laws of Weining Yi, Hui and Miao Autonomous County so as to increase the deeper understanding of the mode of governing the city by laws in the governing practice in China. This paper is divided into three parts:The first part analyzes the implementing background and governing characteristics of these two governing modes penetrating from western governing mode and the theoretical origin of Chinese current governing the city with laws aiming at investigating through setting Chinese governing by laws in bigger language environment and concluding that the current mode of governing the city with laws in China is corresponding with the development condition of Chinese social and economy. The prosperous of western governing theory especially its own political and cultural tradition; citizen’s culture is especially developed, the tradition of citizen autonomy existed since the old time, all of the above factors are beneficial to cultivate citizens and social organizations to take part in the social management of the government. China is in the period of social transformation and has its own traditional political and theoretical practical background from governing by ritual to governing by laws. It can get the following enlightenments through comparison of the two kinds of governing modes of western governing theory and governing by laws in China:On one kind, western governing theories have enlightenment function and practical value to governing by laws in China; On the other hand, China is a socialist country with characteristics and it has its own governing background and the development of governing by laws is accordance with the development degree and rules.The second part develops exploration from three perspectives including concept, system and practice of governing the city with laws of Weining Yi, Hui and Miao Autonomous County. The concept (guiding thought) of governing the city with laws of Weining County comes from Deng Xiaoping Theory, the Important Thought of "Three-representatives" and Scientific Outlook on Development. The system construction of governing the city with laws of Weining County is discussed from four aspects including party policy operation system, economical operation system, judicial work system and mass work system. The practice of governing the city with laws of Weining County is discussed from three parts, including the practice of the National People’s Congress legislation, promotion of governing by laws and administrative enforcement of law. The National People’s Congress legislation mainly discusses the actual development condition of the function of the National People’s Congress legislation and focuses on the legislation exploration of autonomous regulations and separate regulations. The development of the promotion work of governing the city with laws of Weining County is diversity and focuses on promotion of governing by laws of "six entries". Administrative enforcement of law of the governing emphasizes on establishing and perfecting administrative decision-making mechanism, promoting the publicity of government information comprehensively, implementing administrative enforcement of law strictly, and pushing the construction of basic democratic legislative system and the development of mass work.The third party explores the difficulties existed in the process of governing the city with laws of Weining County as well as countermeasures. The subject of governing the city with laws of Weining County is the government, participation degree of the public under such mode is very low and sometimes the practice of governing the city with laws is reflect on summary reports in the conferences of all kinds of departments. However, The government shall restrain and delegate its own power so that the public can participate in the process of governing by laws actually, which can create the free and equal legal environment of Weining County and promote further development of Weining County. |
