Research On Guarantee System Of The Right To Know Administrative Information

With democratization and law going on, the secret model of conventional administrative management has not been able to match the social development. Nowadays, it is the hot topic to establish the open institutions of administration to make the public have the right to know administrative information. In our country, the legal system construction that guarantees the public's right to know administrative information just start carrying out the right to know administrative information depends on the policy measure excessively, become formalistic, this kind of right arrives a full guarantee very seldom. According to the above-mentioned consideration, this paper tries to change former scholar's research mode studying only the open administration, regard the right to know administrative information as the point of departure and marriage of the research, positioning the open administration on the way, means, path of guaranteeing the right to know administrative information. This paper includes three parts:The first part is the theories analysis to the guarantee of the right to know administration. Pointing out harmness of ignoring the administration knowing, completely analyzing the proper of the guarantee administration knowing, and dialectically pointing out the limitation of the guarantee administration knowing.The second part makes reference to the experience of the government's information openness and the construction of law system in the foreign country, and puts forward the suggestion that our country should put the openness of the government's information and establish "the Government's Information Openness Law".The third part analyses how to build the system construction of the guarantee of the right to know administration information. Commencing from the administration guarantee, the judicatory guarantee and regulation guarantee, by the compare research, drawing lessons from foreign countries, to build the system of knowing, relief and supervision in the right to know administration. The right to knowing is not a luxury goods, but an essential right of citizen. With the theories research, the lawmaking perfect and the system construction, we firmly believe that, the citizen's right to know administration information could be certainly and lastly guaranteed.
