| This paper starts with an introduction of portraiture right theoretics and curtrent situation of legislatio, accordingly, it will focus on a hot-issue that press and journalist are recentaly become the defendants in portraiture right cases, however, the judgements are still in dispute. By ultimate invetigation, it indicates reasons for such dispute are absenc of portraiture right theoretics and corresponding legislation, which does not match with modern makrket economy environment. To furhter explain what elements currently exsits blank and should be added, including uncertain subject, incomplete object, the disputed composition essentials of liability for tort and blank exception from liability.Then, structure of this paper will be divided into three sections: firslty, mainly elaborate traditional portraiture right in details, combinating with mass insustrialization idea-"two-cut" that refers to news reporting and mass operation exsit respectively, may point out that in fact such "two cut" thought would be the appropriate way of dealing with portraiture right disputes. Secondly, different protections orientation of portraiture right are discussed respectively. On one hand, sole reportings have an influence on public interest, therefore, they should have more exceptions from liability when reporters using portraiture during their work, and also disadvantaged groups should be paid attention to and provided with aslant protected for them; on the other hand, press operation behaviours should obey equality subject principle regarding to mordern economic rules. Applying fundamentals to resolve correlative disputes. For that reason, it is apparente that such two thoughts have different rules and regulations. Meanwhile, this paper will propose discriminative standards referring to confusing among news reportings, news advertisements operated by media and advertising news. Finally, legal responsibility for tort of portraiture right has been confirmed.
