Comparative Study Of Legal Principles Of International Telecommunication Liberalization

Every profession has adopted positive measures to standardise their markets in order to connect with the international trade since our entry of the WTO. As a foundation industry, Chinese telecommunication also strides forward to the WTO rule. Chinese telecommunication has developed considerably since the establishment of China, especially during the 20 years after the enforcement of the reform and open policy. Chinese basic telecommunication service and increment telecommunication service have got great progress. However, there are still some problems in Chinese telecommunication compared with that in developed countries. The prominent problems are the monopoly of telecommunication which results in the restriction of competitors entering the market, unreasonable allotment of public resource, serious interior unfair competition, monopolizing fixed price of the enterprises, difficulty of improvement of telecommunication service quality and so on. Those various and harmful behaviours in Chinese telecommunication must be broken thoroughly.Chinese telecommunication does not meet the requirement of WTO in many aspects, and there is obvious distance from that of developed countries concerning its opening of market, service consciousness, and research of technique. The problems that Chinese telecommunication is facing now can not be solved only by the reform of policy and management. The main reason which causes the gap is the style of management which has been implemented in Chinese telecommunication and the imperfection of Chinese telecommunication legal system. The thesis introduces some agreements related to the telecommunication under WTO and compares the legal practice of the telecommunication reform. It presents the strategy of improving the comprehensive competition of telecommunication in a period of challenges combined with chances by analyzing the interior and exterior situation of Chinese telecommunication and exploring the characteristics of present telecommunication, which hopes to motivate the steps of legal construction in Chinese telecommunication.
