The Research Of Complaint System For College Students

The complaint system for college students is an important part of the system of managing college by law in china. Meanwhile,it is the relief mechanism for legal rights that college students must achieve. The 42rd article of education law of people's republic of china clearly stipulates the right of complaint of students,specific regulations of complaint system can be found in the new Regulation on the Administration of students in Regular Higher Education Institutions,including its corpus,scope,time limit,rule covering,procedure,etc. Compared with the old management regulation of college and university students , the new regulation makes greater progress and can carry it into practice . However,the current complaint system of college students in our country is not perfect and has many flaws in the enaction and in the practice as well. So the complaint system for college students need to be amended and be perfected. As to the presenting problems of the complaint system,how to perfect the complaint system has made the exploration in the thesis .The thesis includes three parts,the basic content of the thesis can be summarized as follows:The first part:Introduce the basic theory of complaint system for college students,including its theoretic base,basic legal charatertics and function to achieve the purpose of have the understanding of complaint system. Right relief theory and procedure justice theory are the theoretic base of the foundation of complaint system . Its function embodies four aspects: right relief,control and supervision,promotion and education,and management.The second part:through analysing the law regulation about the complaint system in our country and making the analysis to these stipulations,especially according to the new management regulation of college and university students,point out the flaws of complaint system,including its scope,its constitution of committee etc,then expatiates the necessity of perfection of complaint system for college students .The third part:according to the flaw existing in the complaint syetem for unversity students,from four aspects,the necessity of perfection of the complaint system,the basic principles,the legislation perfection and practice methods,concretely including broadening the scope of complaint system,ensuring its procedure justice,constituting a qualified complaint committee,enacting the lawful and right regulation,to perfect the complaint system and to make sure that the right of complaint of students can come into ture and that the lawful rights can be safeguarded by law .
