With the development of the economy in our country, the increase in constructing residential district areas and strengthening sense of the residents' protecting their own right, people are now concerned not only about the quality and the ownership of their housing but also about the parts for public use, the utilities as well as the use of their proprietary rights. At present, it is difficult to determine the ownership of the common rights in the from of certificate because there is still no concrete information about the communal parts which are often abused by the inventors and the management of real estate. Therefore, there are increasing disputes about the use of the communal parts, such as parking lots, green areas, assembly places and the common passageways. Although recently the Property Law has made simple explanations about the ownership of some more disputed aspects, it is still impracticable in some ways. And the low level or lack of legislation in this a spect makes courts at different levels unable to deal with this kind of disputes in an efficient way.This thesis is developed into four parts, further discussing the proprietary right of the communal parts in commodity building areas. The first part presents the main juridical logic analysis of common rights of the share parts in the residential district areas. The second part deals with the relationship between the common rights and the investors. The third part focuses on establishing the main part of using the common rights through enacting legislation, the shortcomings in carrying out the rules and the opinions of improvement. The fourth part discuses the ensuring mechanism.
