The building title differentiation is the form of proprietorship of real estate in civil law. There are three kinds of law meanings about it: especiallyowned rights, the building title differentiation and the common management. Especially, the building title differentiation is very complicated. In our life, the issue about the building title differentiation happens more often.In China, Proprietary Rights Law is the first time to model the building title differentiation, but it is only 14 pieces, one chapter. I think it must have some omissions. So in the article, I have some additional ideas about it according to some foreign laws and our own laws. It is including five parts.In the first part, the law general outline, its means and characters are briefly introduced. They are helpful leading to the building title differentiation.In the second part, the types, law characters and its qualities of the building title differentiation are talked about. I analyze its characters and think it should be taken as to share by portion, that is, not to ask for the division of shared title. It conforms to aims of Proprietary Rights Law.In the third part, the article talks about the object of the building title differentiation. That is joint part of the building and its ways of dividing line. Especially I emphasize the using rights of the roof platform, building ground and the belonging of greenland outside the window, garage, parking places and public facilities, only after clearing the common parts, then we can provide clear base and solve the issue of the building title differentiation.In the fourth part, the article talks about the rights, the responsibilities and legal responsibilities of the building title differentiation.In the fifth part, the article talks about the law system of the building title differentiation. It is mainly connected with the sixth chapter of Proprietary Rights Law. It emphasizes its missions and gives some pieces of advice.
