The rural development issue in our new rural construction is still the "three rural". The solution of this problem to some extent depends on the rural economy organization innovation. The topic of rural small and medium enterprise is hence proposed.Thus, firstly, to address this issue, I raised the topic of rural small and medium-sized enterprises, and propose it as the solution for our rural economy development. The first section of this thesis is the proposition of rural small and medium-sized enterprises. Chinese long-term urban-rural dual economic structure system has result a "divide and rule" situation. The rural areas find it difficult to reverse this situation and their disadvantages. The restricted flow of rural production and the lagging of rural market economy have further hampered the strength, depth and breadth of the rural economy development. On the basis of empirical analysis, I believe that it is possible to carry modern enterprise and basic traditional rural agricultural elements through "enterprising".Since the most suitable enterprise types in rural area are small and medium-sized enterprises, I emphasized on establishing the legal systems that is necessary for the development of rural small and medium-sized enterprises. Because there are no specific analysis and definition on this topic in china so far, it is necessary to define"rural small and medium-sized enterprise". In comparative analysis based on the basic concept and related concepts, I believe that"rural small and medium-sized enterprise"should be defined by using enterprises as its premise, small and medium-sized enterprise as its definition basis, and special geographical scope as its limitation.In order for the solution of the rural small and medium-sized enterprises to have the protection from the authority of the system, we need to study the characteristic and pattern of Law for its legislation. And the law need reflect a policy to promote and support the features of the Act. The selection of the law mode can have a direct impact on its legislation construction and also its ultimate implementation. In reference to the law mode of foreign small and medium-sized enterprise, combined with our existing legislation and promotion of rural enterprise, the law mode for our rural small and medium-sized enterprise should be Systematic legislation.The design of the law mechanism can be constructed from the following aspects. 1) Define the scope of rural small and medium-sized enterprise and its legal status. 2) Identify their management and their functions. 3) Set up The Regulation Act for Social service organizations for rural small and medium-sized enterprises. 4) To Specialize The Regulation Act for Financial policy for rural small and medium-sized enterprises.
