Lotteries are legally and fairly issued by the nation so as to relocate social scattered funds to provide necessary funds for utility, which has not only relieved financial pressure of the nation but also coordinated social contradiction and relations to some extent. However, lottery has certain negative effect, for instance, its economic anaclisis and gambling feature can easily result in social problems. Therefore, the nation should implement rational instruct, controlled development and strict management when it is making lottery policies and regulations.As the outcome of the reform and opening policy, lottery in China didn't get started early, but developed fast. The ways to issue lotteries keep updating and the scale keeps enlarging, which have greatly accelerated the development of social welfare and physical education. However, lots of unstable factors in China's current lottery market and some remarkable problems have gradually come out, which are mainly manifested on market system obstacle, legal mechanism obstacle, supervision management obstacle and profit coordination mechanism obstacle, etc. To overcome those obstacles, on one hand, we should reform our current lottery market structure, implement enterprise operation supervised by the government, and realize the separation between supervision and management through establishing an integrated specialized lottery supervision organization. Meanwhile, we should further perfect management and employment system of public welfare fund, so as to severely beat private lottery and protect the rights and interests of lottery purchasers. On the other hand, we should learn from the successful experience of foreign lottery legal system and construct and perfect our lottery legal mechanism starting from the issue of lotteries, sales system, market supervision system, management and employment of public welfare fund, and legal liability, etc., so as to systematically guarantee healthy and orderly development of lottery industry.
