Environmental Impact Assessment System (EIAS) isa very critical reform for traditional economical developing mode that wastes natural resources and destroys. the environment. EIAS is also an important tool for management. The reality proves environmental issues can be well solved through reasonable and improving EIAS and supervising policy. Both China and America are great countries in terms of population, territory area and natural resources. They are mutually complementary in many respects. America is the first country that introduced EIAS which helps it has made great achievement in the environmental field. Therefore, it is very valuable to study American advanced experiences. This goal of this article is to compare the differences between Chinese and American EIAS and to improve Chinese environmental legislative system.This paper compares and analyzes the present situation and trend on Chinese and American EIAS. It finds out the advanced experiences that are good for Chinese EIAS to learn. It studies the Chinese and American legislative philosophy, public participation system, categories and legal responsibility. It makes some suggestions on improving Chinese EIAS. It argues that Chinese EIAS should be improved in the following aspects: developing strategic EIA, strengthen the EIA on alternatives, public participation, reviewing system and process.
