The Legal System Of Environmental Impact Assessment Research In Our Country

Based on the basic theory of economic law involved in theenvironmental impact assessment (EIA) legal system, the paperanalyzes concepts and characteristics of EIA legal system anddiscusses the necessity and urgency to improve the EIA legal system.It especially emphasizes the three aspects of our national EIA legalsystem, that’s the legal system of planning EIA, the legal system ofconstruction projects EIA and the legal system of Strategy EIA. Fromthese three points’ actual contents and operational procedures, itcomes up with its legal consideration. Learned from overseas EIAlegal system’s basic aspects, this paper analyses their enlightenmentsand examples which effect on our related systems. From economiclaw aspects, the paper discusses the EIA system by legal analysis, andfrom EIA and sustainable development, EIA and macro-control, EIAand ecological civilization construction, EIA and protect the people’slivelihood, EIA and social management these five aspects, this papergives its theoretical demonstration about our EIA legal system. As forthe existing problems and weak points of EIA legal system, this paperalso figures out the countermeasure suggestions.
