A Study On Legislation Of Preventing The Pollution Of Solid Wastes In Rural Areas

China is a large agricultural country. The population of the rural areas, which accounts for about 70% of the total population, is about 900 million. With the rapid rural economic development and the improvement of the living standards of farmers, many of the environmental problems have become increasingly prominent. Rural ecological environment is worrisome, especially the problems of the rural solid waste pollution. Rural environmental quality has further deteriorated; this kind of situation is not only threatening the peasant health, and also constraining the further development of the rural economic. However, the rural solid waste pollution has not attracted the attention of relevant departments, the laws and regulations of this field are rare. The fifth plenary meeting of the 16th Plenary Session of CCP has proposed that: we must proceed steadily building the new countryside according to the requirement of production development, wealthy life, good rural civilization, clean village and democrat management. Clean village as one of the important new rural construction contents provides the environmental support for the establishment of the new village. But rural solid waste pollution is the main reason of the rural dirty, chaotic, and poor environment. Therefore, prevention and control work of the solid waste pollution must be strengthened if we want to precede the construction of the new socialist countryside.China has taken some measures in the legislation to deal with the rural solid waste pollution problem and promulgated a series of laws and regulations all referring to solid waste pollution prevention of the rural environment. But facing the grim situation of the rural solid waste pollution, it has prompted us to think about how to improve the legislation. This paper attempts to give some legislative proposals on the shortcomings of China's rural solid waste pollution prevention legislation. The article is divided into five chapters:Chapter I was the literature statement, it mainly introduced the purpose, methods, expecting results and innovation of this research study. Chapter II was the summary of the rural solid waste pollution. It briefly introduced the rural solid waste concept, type, harms of the rural solid waste polluting environment and its cause.Chapter III described the state of legislation about the prevention of rural solid waste pollution in China, including the Constitution, the Basic Law, the Single Law, administrative regulations of the State Council, departmental regulations and local rules and regulations and the relevant regulations of other laws, and made an evaluation, summed up the lack of China's legislation on the rural solid waste pollution prevention.Chapter IV presented the legislative situation on the rural solid waste pollution prevention of the foreign country, including Germany, Japan, The United States and Sweden. It aimed to make up our storages by taking other's advantages and provide a useful experience for improving our relevant legislation.Chapter V proposed some related legislative advices of our rural solid waste pollution prevention. First, it discussed the legislative principles and legislative basis, and then it proposed how to establish and improve the prevention legislation of the rural solid waste pollution in China.
