Government regulation and the special market structure of civil aviation industry, leading to several kinds of monopolistic behaviors. With the continuation to enhance the level of competition in civil aviation, antitrust law have more and more jurisdiction over civil aviation, and the enterprises of civil aviation may be doubly regulated by civil aviation regulator and antitrust authorities when they have monopolistic behaviors, so we must scientifically and rationally set power division model and cooperation mechanism between two government departments.Besides the introduction, there are six parts in this paper. The introduction mentions the research background, defines the research scope, proposes the key issues to be addressed, and summary other people's related research achievements. Firstly, this paper focuses on the special industry attributes which are the foundation for government to regulate the civil aviation. The second part and the third part mainly introduces the regulation systems and market structure of civil aviation in our country, and the two parts pave the way for the further analysis. The second part contains the process of management system reform, regulation authorities, and the regulatory measures in civil aviation of our country. This part also analysises the positive significances of the regulation to civil aviation, such as to protect social public interests, industry interests, consumer rights and so on. The third part mainly discusses the market structure of civil aviation and its impacts on the competition strategies of the enterprises in civil aviation and the power distribution on antitrust enforcement. Subject to government regulation and the special market structure, the fourth part lists the monopolistic behaviors in civil aviation: price discrimination, exclusive dealing, price-fixing cartel, boycott, hoarding flight time, unreasonable occupation of airport facilities, large concentration of business operators, etc. On the basis of the previous article, the fifth part points out the division model that China should choose after the analysis on foreign practice and several factors which may influence the choice of division model. To ensure the effective implementation of the shared model, the sixth part designs the coordination mechanism on legal authority, coordinating agency, program cooperation, legal responsibility and dispute resolution.
