The Research On The African Human Rights Protective Mechanism

Since the World Warâ…¡, the problems of human rights protection have been noticed by the world society and entering into the field of international law on large-scale. With a view of the slow progress of global human rights protection, countries in the world tend to protect human rights in regional way, because of the more unified standards and more concrete right subject on the base of similar history, politics, economy, culture and religion. African human rights protective mechanism should be especially noticed for its special human rights protective mechanism with using the reference of European human rights protective mechanism and copying the relative international human rights laws.This article studies the African human rights protective mechanism on three phases in comparative and positive analytical way. At first, the backgrounds and concrete contents of African human rights protective mechanism are to be introduced as a premise and foundation. Here African human rights legislations, institutions and protective program systems are emphasized. Secondly, African human rights protective mechanism is to be appraised and compared with American and European regional human rights protective mechanism. The author thinks that African human rights protective mechanism is an effective complement of the UN human rights protective mechanism, for it protects the traditional human rights as well as the new generation of human rights. It expands the scale of international human rights protection with accepting and confirming the global human rights pledges. At the same time it entitles the single human and Non-government organizations complete rights to petition, challenges the traditional theories on international legal subject and promotes the development of international protective mechanism. On the other hand, the author analyses the defects of African human rights protective mechanism's operation and points out the flaws should to be perfect. At last, the author claims African human rights protectiye mechanism enlightens the international human rights protection greatly by telling us that only when tackling well with the relationship between human rights and sovereign can we realize the real complete protection to human rights. The author points out the flaws on Asia and China human rights protection as well, acclaims that African human rights protective mechanism gives good reference not only to the establishment of Asian human rights protective mechanism but also to the construction of Chinese human rights protective mechanism. At the same time she gives advice and countermeasures on the establishment and perfection of the relative mechanism.
