Study On The Success And Frustration Of Law Construction Of China From 1949 To 1966

After the foundation of P.R.C, the historical course of law construction has began under the lead of communist party of China. During the first seven years, goals were achieved, old law being adapted, judicature system being perfected and many new laws being issued. However, what came after was big frustration, in which the law was abandoned and judicature system was eliminated. Civil rights were infringed and the whole society was chaotic. A number of scholars think that the expansion of the struggle of anti-Rightist is the main cause of the transformation of the legal development. It is worth of discussion. Based on this, this essay attempts to analyze the situation of the legal development in our country, so as to find out the real cause of the failure of the rule by law.From 1949 to 1966, the political movement became the main theme. Through the study on the function of law during the political movements, this essay tries to analyses the reason why the law construction failed in China and summarize the experience from this frustration.
