A Research On The Judge

It will help us a lot to fix the profession position of a judge , to discover the contradiction and predicament of the current Chinese law development and to form the real legal person by defining the connotation and the denotation of the word"Judge"and researching its linguistic process of the meaning.Based on this goal, this article has conducted a preliminary research of the evolution of the word"judge"as well as the development process of the judge system. The article has inspected the Chinese ancient law system and made the conclusion that the source of the ancient judge's power and also the aim to exercise the power came from the maintaining of the King's political authority. The article has also examined the modern judge's existence elements and characteristic attributes, and concluded that the true modern judge can not be found before the rule of the law has been finally established. Considering the insufficiencies of the current judge community and the law system, this article proposes to construct the modern judge professional community and promote the process of the judge professionalization. Finally, the article draws the conclusion: it is not only that the Chinese ancient times never had has the government by law, moreover it is impossible to appear the government by law and more impossible to appear the real judge with the modern judge characteristics. To promote the construction of the Chinese rules of law, the current judge system should be carefully analyzed to explore a way for the improvement .
