| In legal society, legal mass media, on the one hand, entails the task of publicizing legal information, propagandzing laws and politices, monitoring legitimate and institutional environment and on the other, guide the citizens to obey the law, popularize legal knowledge, warn violating the law, impart and inherit legal culture, enrich popular culture and offer legal advice. Briefly speaking, the transmission of legal knowledge through legal mass media life can be observed anywhere in our social life. Novertheless, the properous development of the legal mass media exposes something inevitably negative, which can by no means be ignored. Exemplary cases as severely false legal news, riotous or ponographic criminal messages, hearsays full of vulgarity aiming at curious attraction, redundently lengthened legal news as well as some invented stories or comments, are all triggoring matters that may cause some negative problems leading to crimies or the possible disbelief of the public media, malspreading legal information so that the normal social order, the guarantee of the public interest, the administrative and executive management, judicial justice or even the authorativeness of the legal norms may be severely detrimented in consequence. The above-mentioned potentiality of the public media ought at all to be seriously observed far and wide in our extent sicial life. Therefore, the free discretion of the negative legal news overshadowing the possitive ones should by any means be rationally imposed upon.The present endeavour tries to devle into some phenomenal aspects concerning the freedom to transmit and express legal news, seeking potential ways on how to safeguard legitimate transmission system of legal news in current social life in China where a hamonious society is being formed for the purpose of adequately substantializing the function of the legal news as a popular transmission machenism, making every effort to curb the negative influence of the legal news in the cause of constructing a harmonious social condition so that the legislature on public mass media be advanced until it is consequently perfected.The thesis is divided into four chapters elaborately dealing with legal news and the freedom to express by means of contrasting, categorizing, case analysing and making stastical studying.The first part is the introduction of the desertation, the raw material of which is a legal story: A Murder Case Resulted from a Bon adopted from the wirelessprogram--legal story on line and its author's thoughtful reflection on legalnews and the freedom of expression.The second part is the body of the disertation consisting of four chapters as follows:Chapter one argues about spreading of the legal case, The Murder Resulted from a Bon, and transmission of legal news, clarifying the relationship between what the news is, what the transmission of the mass media and what the notion of legal news means with the discussion over whether it is belonging to legal news, drawing a conclusion that the Murder Caused by a Bon should be catergorized into fragmented legal news representing postmodernism, instead of symbolizing rational viewpoint of legal news advocated by main culture. The last part of this chapter precisely summarzies heuristic points about the freedom to express of the legal news through analytical study of the Murder Caused by a Bon.Chapter two offer a comprehensive exploration into the freedom of expression in the historical development of the legal news in China, including its reality, legal institutions, content, idiosyncracies as well as some relevent comment on freedom of expression in the cause of transmission while the freedom to express of the legal news in capitalist countries being analyzed. In addition, this chapter classifies the freedom of expression of the legal news into justifiable freedom, exceeding freedom of expression and the freedom beyond the law with their interrative demarcation. In the third chapter, the author takes the following cases exposed by public mass media like the event taken place in Dashi Village, the controversy over bequeath by concubine in Luzhou, Sichuan province, the case of Jiang Yanping, the additional lawsuit against the journal Finace, Xiang Fei, television hostless as exemples for making comments upon the right to know the truth by the parties concerned, the truthfulness of legal news, the relationship between freedom and judicial right in the course of expressing news reports and the professional virtue of the journalists.The fouth Chapter, on the basis of the current state of the freedom to express of the legal news and on the basis of the specific period when our society is on the threshhold of the turn to constructing harmonious society in China, proposes that the policy and legal, administrative, judicial as well as self-disciplinary protection to the transmission of the legal news by means of some correlative theories such as the doctrines of purposefulness, of culture, of evilness in human nature, gambling, effectiveness and theory of Marxism for the purpose of improving legal system and legislature on journalism to protect the freedom of expression of legal news in the specific period when a harmonious society is being built in China.The last part of the thesis is the conclusion. The case of Murder Resulted from a Bon triggered the public observation about the freedom of expression in legal news and the legislature on journalism. The author believes that, legal news, moulding the spirit of law with the influence over the public readeres, should accord with the modern legal spirit and judicial notion. However, the essential precondition of the above-mentioned matters are to protect the right to hance freedom of expression for all the journalists, only by so doing can the full right of freedom to express and the advancement of legal civilization and judicial reform be achieved. And furtherness, only by so doing can we distinguish the right from the wrong in legal government, can the transmission of social justice and the good faith in market economy.
