Community Correction In A Harmonious Society

Community correction is a kind of punishment contrast with prison correction, and it is a main method to punish criminals in western counties. On July 10, 2003, the going into effect of (hereinafter referred as ) and issued by the Supreme Court, the Supreme Procuratorate, Ministry of Public Security, and Ministry of Justice, emblematizes the community correction system has been started to practice in China. After then, Beijing, Shanghai, Tianjin, Zhejiang, Jiangsu and Shandong province have begun to developing community correction. At present, Experiment unit of community correction has been established in 18 provinces. Development of community correction in China emblematizes a fundamental innovation of penalty execution system of China, and also is one of basic issues for establishment of a harmonious society in China. In order to promote community correction to play its role in establishment of harmonious society, the author studies issues on community correction both in China and abroad, and gives some suggestions on it. This thesis is divided into 4 chapters. Chapter 1 is about definition and origin of community correction. First of all, the author introduces different definitions by scholars of community correction, and analyzes some basic characters of it. Next, the author discusses development of the theory of community correction, and reviews development process of community correction system. Chapter 2 is about practice quotable value of community correction in some counties and regions. First of all, the author studies practice of community correction in Britain, Minnesota of USA, Germany and Japan, and summarizes their quotable values, including perfection of legal system, advance of theory, setting of measures, participation of governments, nongovernmental organizations and individuals, etc. Chapter 3 is about value analysis and present situation comment of community correction in the process of establishing of harmonious society in China. First of all, the author analyzes value of community correction in aspects of promoting social stability, humanization of penalty, and saving of social resource. Next, the author gives his comment on the present situation of community correction in China, and points out the room for improvement of understanding for community correction in present China. Contrast with foreign countries, limitation of China's present community correction system goes as follows: measures of community correction are adopted in a narrow scope; Legal system of community correction is not perfect; protection for criminal's right is not good enough; modern management is lacked. Chapter 4 is about the author's thinking on establishment of community correction for a harmonious society. Based on judicial practice of China, the author gives his suggestion on establishing and perfection of legal system of community correction, measures for innovate and polish community correction system, enhancing establishment of organizations for community correction, development of experiment unit of community correction, exploration of modes of community correction suitable for China's present situation. At last, the author summarizes the thesis briefly, and points out that community correction is symbol for development of civilization of society. By promoting and development this system, we can not only innovate our present penalty system, prevent and reduce crimes, but also maintain the society's lasting peace and stability, and implement political civilization and social harmony. At the same time, the author sets forth that in order to promote the society's lasting harmonious development, in the process of developing and improving China's community correction system, we have to marry theory with practice and learn foreign countries' advanced experiences on the basis of the principle of being practical and realistic.
