Research On Rules Of Origin Under Regional Trade Arrangement

With the development of the economic globalization around the world and the increase of tariff concession, the protection to domestic industry by tariff has dramatically undermined by reduction commitment of related parties. In order to protect their domestic industry, more and more non-tariff measures have been employed by states. In RTA, rules of origin are widely launched to protect the security of economy and politics.This paper gives an outline of the rules of origin under the RTA from the height of theory after the introduction of its legal basis. Then, it compares the rules of origin under RTA with non-preferential rules of origin and GSP rules of origin, so that we understand this conception deeply. This paper focuses on those criterion and provisions of rules of origin, which are widely used in RTA, like substantial criterion, the cumulation of origin, rules of direct transport, rules of package and so on. At the last part of this paper, it introduces the present situation of CAFTA's rules of origin, analyzes the problems of its rules of origin. Based on foregoing analysis, this part brings forward some advice to fully exert the important function of rules of origin under CAFTA.
