On The Judicial Power Structure And Its Optimization

The judicial reform is being carried out like a raging fire in the national scope. Research on some related issues is undoubtedly of great theoretical and practical significance under this background.various measures were introduced one after another in the recent years' judicial reform , but many of them were imposing before implementation while being silent after it. There is a close relationship between the judicial reformers' cognitive errors on the basic goal and theory. A viewpoint, the focus is three-fold : the first is the judicial power status in the country's political structure, the second is the judicial power structure, and the third is the civil rights. Among them, the last is the ultimate goal. The reform of the judicial power structure is the judicial organs ' internal reform ,which will directly affect the judicial reform, the exercise of jurisdiction, and the protection of the civil rights .The paper locates in the reform and consummation of the judicial power structure. Beginning with some basic theoretical issues as research objects, such as the connotation and characteristics of the judicial power structure, the main bodies of the judicial power, the judicial power, the relationship between the main bodies of the judicial power and the litigants and so on, the paper analyses the present situation and some existing problems in our country's judicial reform. The paper also proposes some feasible suggestion in improving the judicial power structure.The paper is divided into four chapters. Each main contents are as follows :the first chapter, the connotation of the judicial power structure ,including the definition and character of the judicial power, the meaning of the judicial power structure , the value aiming of the judicial power structure and its achieving way.the second chapter, the judicial power structure - dimension of experience .The content includes the overseas judicial power structure and our country' s history of the judicial power structure.the third chapter, self-criticism in our country 's history of the judicial power structure , including the theory cognition and self-criticism in practice.the fourth chapter, suggestion in improving our country 's judicial power structure .The content includes the decomposition of the chief director' s authority , the consummation of the lawsuit system, the reconstruction of the judge system , the far-reaching influence of the judicial investigation power and so on.
