Theory Of Community Rectification In The Harmonious Society

Community rectification is a non-prison punishment way of placing criminals who match the condition to community and rectifying their criminal psychology and behavior abuse with assistance of public organization, nongovernmental organization as well as social volunteers by the control of special state organs to prompt their return during the period of sentence, judgment and confirmation , and which is a relative method of carrying out a sentence and Prison Rectification. Community Rectification originates from Western countries, such as Britain and the USA, which is an embodiment of international trend of punishmentsystem from severity to leniency .It makes prominent importance of prompting the return of the criminals, mitigating the economic pressure of the prison, avoiding the cross infection of light punishment criminals, deploying of execution resources and promoting a virtuous cycle in the public order. Firstly, investigating and analyzing in this thesis with a view to a macro-backgroung of building a harmonious society. Inspecting the connotation and characteristics of the two concepts of community rectification and harmonious society should pay more attention to their dialectical relationship macroscopically; and Secondly, analyzing the condition of the places practicing community rectification and the defect of the implementation in building a harmonious society. On this foundation, make the guidance of building a harmonious society and the view of scientific development, start with insure the improvement of legal system and make a goal of human oriented overall harmonious development between human and nature, human and society, people and people to put forward the countermeasure and suggestion on community rectification in building a harmonious society.
