Study Of Law On Food Safety In China

Nowadays, food safety problems, which are related to people's health and every country's development stability, become the whole world problem that every government and consumers pay the utmost attention to in the few years. Food poisoning incidents happen frequently in the whole world, and governments take steps to secure the food safe, such as establishing food management, making standard. The current food safety situation of our country makes the law react to it. The characteristics of food safety also need regulating.First ,this paper analyses several basic conception, such as "food", "safe", in the purpose of providing a logic premise for the following content.Second , the paper analyses the present food safety legal system in our country. Obviously, there are quite a few drawbacks both in legislating and enforcing the law related to food safety. Regulations have no accordance and execution among them. Enterprises are short of administrative regulation. It is necessary to regulate food safety problem by law.In the third part, the paper has introduced experience of other developed countries, in purpose of providing some advanced legislative experience for our country.At last part, this paper reaffirms the emphasis of the improvement of food safety legislation, puts forward the approaches, principles, and general ideas of construction, depend on our country's condition. The approaches for food safety regulation we should choose is constructing a main law in food safety, clarifying each supervisor's authority and responsibility. The emphasis of the improvement of food safety legislation is: The duty of food safety, food safety standard, system of market accessing system of food safety, information system of food safety known to public, safety regulation of genetically-engineered food, and label regulation of food, the system of calling defective food back. In this process, the government should establish a comprehensive food safety supervisory system. I hope the paper will be helpful to food safety legislation in our country.
