Research On Legal Issues Of China’s Food Safety Regulation

In recent years the national food safety accidents constantly outbreak,unsafe food endanger people’s life and health everywhere, and affects thedevelopment of national economy and the survival of mankind. Foodsafety is a significant problem related to people’s health and livelihood.Therefore, domestic and foreign experts and scholars, who do a lot ofresearch from different position and angle of food safety monitoring andlegal issues, play a positive role in practice. But long-standing food safetyaccidents let us see that the current food safety supervision still has manyloopholes and imperfections, such as unsound food safety standards andbasic system, the lack of systematic and coordination among food safetylaws, low quality supervision personnel, the lack of accountabilitymechanism, unclear responsibility of supervision departments, a lack ofco-ordination between departments and supervision mechanism ofjudicial procedure and social supervision.This paper mainly has six parts. The first part mainly put forwardproblems and provides the necessary theoretical basis for the legalresearch of food safety supervision in China by means of summarizingrelated literature and scholars’ research at home and abroad. The secondpart defines concepts of food safety and the supervision of food safety,analyzes the theoretical basis of food safety regulation, and then putforward the necessity of food safety supervision；The third part mainly describes the current situation of supervision of food safety in our country,and analyzes the existing problems of Chinese food safety monitoring,including regulatory legislation, enforcement process, the judicial process,external supervision and so on. The fourth part mainly introduces thecharacteristics of United States, the European Union, Japan and otherdeveloped countries’ food safety supervision system, analyzes andsummarizes the enlightenment to us through comparing the food safetysupervision system abroad.The fifth part mainly come up with legal measures to perfect ourcountry’s food safety supervision from regulatory legislation, regulationbasic institution, supervision law enforcement measures and externalsupervision and the environment of the perfect our country respectivelyregulation of food safety law, and put forward a series of feasiblemeasures to improve. The sixth part is the epilogue parts. The authorsummarizes the main problems of food safety supervision, defines theimportance of clear food safety regulation, and then put up with moreeffective measures to perfect the regulation of food safety laws.Through summarizing and analyzing main problems existing in thepresent food safety supervision, this article points out the problems inlegislation of food safety regulation, regulatory enforcement, regulatingmeans and measures, supervision program, regulatory environment andother aspects. It also comes up with legal measures to improve the food safety supervision based on ideas and measures in foreign advancedsupervision, and Chinese basic national conditions. With the limits ofpractice and work experience, researches of food safety monitoring andlegal problems focus on the theoretical level. The actual supervision offood safety research does not go far enough, which needs the furtherexploration.
