The relationship between men and women is one of the oldest issues in human history. Both men and women contributed greatly to the development of human society in the past thousands of years. However, after the transition from Matriarchal Society into Patrilineal society, women's social and family status slowly declined and finally became the appendage and foil of men. What is more, the development of productive forces and the appearance of private ownership signified the failure of women in world history. From then on, the inequality between men and women remained even though the productive forces, relation of production and the whole society had changed significantly. Even the bourgeois revolution whose slogans were freedom and equality and which liberated countless citizens from the tsarism of feudal empire still failed to grant women the equal status with men.Men and women constitute our society. The equality between men and women is actually a critical standard of social justice. Gender equality is one of the most important sub-rights of the right of equality granted by the Constitution. Apart from the right of equality, many nations also emphasized gender equality in their constitutions. Gender equality naturally prohibits gender discrimination, requiring the nation to act positively to eliminate gender discrimination. On the other hand, however, gender discrimination is still an extremely prevailing social phenomenon in the world, which means we still have much to do.Obviously, prohibition of law is an effective way to fight against gender discrimination, but gender discrimination is not only a problem of law. Except for law, we have many other ways to solve this problem. Gender discrimination originated long ago and is influential to the society. This article is based on the theory of right of equality, using the data and conclusions of relevant field such as sociology, psychology, religion, history and so on to post gender inequality in China, discuss the origin of gender inequality, summarize the anti-gender discrimination legislations of nations and clarify the constituent, varieties of gender discrimination with the concept of gender discrimination in international convention. Thus, this article contains four parts: Chapter One mainly focuses on statistics which revealing women's political, economic and family status in China. Chapter Two introduces two theories on the origin of gender equality, analyzing possible ways to construct women. Chapter Three discussed the concept of gender discrimination and variety. Chapter Four proposes effective measures to eliminate gender discrimination.
