Search System Research

As an important scouting measure, searching is widely used in scouting and case-investigations in China, and it plays a key role in verifying criminals and arresting the suspects.With the progress of opening and reform, the voice to revise and perfect the searching system in academic field is becoming louder and louder. But there are different opinions upon how to make use of the experince of western countries for reference to improve the Chinese one. The debate about it between academic specilists is well heated.Starting from the Chinese present searching system, the 1^st part analyses and explains its concept, its applied scope, the conditions and reasons of the searching system. Then in the 2^nd part, a comparison and contrast is made between the western searching system and the Chinese one, in terms of the perspective of examining and approving procedures, executive organ and the rights protection of the examinee etc.The 3^rd part puts emphasis on the problems of legislature and judicature, and analyzes the possible causes of the problems as well. Finally, in the 4^th part, on the basis of the above comparison and contrast, the author puts forward some suggestions on the examining and approving procedures , executing procedures and executing time, hoping to help establish an appropriate searching system in China.
