On Reform And Perfection Of Community Correction System

Community Correction, also known as community-based correction or community treatment, means that eligible criminals can be put into communities to carry out their execution work(specific executive work are different from that of prisons). It is called community correction by a joint name. With "governing the country by law" as the theme for the first time, the eighteen session of the fourth plenary session approved a programmatic document named "Decision of the CPC Central Committee on major issues concerning comprehensively promoting the rule of law" which clearly stated that community correction laws should be enacted.Through visiting city two people’s Government, judicial administration department and people’s courts of Rizhao City, the writer has mastered the current situations of community correction in Rizhao City and analized the effectiveness and the problems exsited by using systematic theory. Based on the reasons of the problems and according to the eighteen session of the Fourth Plenary Session of the spirit, the writer put forward with preliminary solutions and analized the aspects of community corrections.Taking the Practice of Rizhao City As an Example, this article mainly analizes the community correction problems, which are devided into four chapters.Chapter one, the introduction part, starting from the purpose of the research and the significance of the study, mainly analizes the current situation of community corrections both home and abroad.Chapter two expounds the definition,characteristics,legal foundation and nature of community corrections.Chapter three researches the implementation of community correction in Rizhao City. Main measures of judicial administration department, "Large community correction mode" of Wulian County, the effectiveness of the court system in community correction and current problems and reason analysis of community corrections in Rizhao City are narrated clearly in this part. Current situations of carrying out community correction in Rizhao City are presented as a whole.Based on the problems and reasons,Chapter four concludes that community correction should be implemented by the following measures, such as perfecting Legal system and system construction, comprehensively promoting the standardization of law enforcement work in community correction, strengthening the correction work, setting up educating modes and judicial systems which adapts to community executive criminals’ characteristics.
