The Study Of Public Participation In Local Legislation

This dissertation makes probe into public participation in local legislation,which is a topic of abundant practice and theories. Public participation in the legislative system is the result of accumulated experience in the long-term continuous exploration and practice on the theoretical basis and legal basis. The necessity and feasibility are also analyzed. It is important manifestation of the masters and important content of the socialist democratic political system, also of great importance to embody democratic and scientific significance and to build a socialist harmonious society. The notion of the design of a system is the core concept of people-oriented, which to express people's interests and influence legislative decisions through proposing, presenting people's views , debating on the question, and supervising. The main forms of participation include solicit views and legislative hearings.Local legislative system is charged with the important tasks about implementation of Central Council, supplement of the relevant provisions .The practice of public participation in local legislation that have done more open and gone further has added much useful experience to the Central Council. This paper studies the practice and cases of public participation in local legislation nowadays from the perspective of Jinan Municipal People's Congress Standing Committee legislation. In practice, there are many problems of public participation, for example, the lacking of right to know, the lack of clarity in rules and regulations; no feedback mechanism in the legislature and the public. To solve these problems, we must improve the existing good practices so that rose above the system level; On the other hand, we should pay more attention to public participation convenience, diversification and other matching system from foreign public participation in local legislative experience.To improve the scope and sequence and efficiency of public participation, we must create conditions to establish interest expression mechanism, incentive mechanism and integrated mechanism to provide safeguards for public participation, so that public participation in local legislation should play a value role not only in the improvement of local legislation quality, but also actively exploring valuable experience for "Legislation Law" on the people to participate in the legislative system.
