In today's information age, the proportion of the third industry in each country is mounting up continuously, especially that of the service industry which has become the leading industry of the 21st century. The rapid development of the information industry based on computer network and the prevalence of the internet has considerably changed human's traditional way of life. As a brand-new commercial mechanism under the background of economic globalization and information globalization, e-commerce has grown more vigorously than ever before. The boost of e-commerce has widely broadened consumer market and their vision of more information, as well as provided a more convenient and faster way of consumption to lower the consumption cost. At the same time, the amount of information and market transparency will be greatly enlarged, which will totally benefit the consumers. Legislation is the regulator of all social relations. Due to the hysteretic nature of laws and regulations and virtuality of internet, this new way of transaction will complicate the relation of each side and will unavoidably aggrandize the possibility of personal injury and property damage. Without the support of macro-legislation, e-commerce can be nothing but a castle in the air.Those behaviors which have already impaired consumers' interest will tamper their enthusiasm and form the bottle-neck of e-commerce, meanwhile, greatly challenge law for the protection of consumers' interests. Thus, how to protect consumers' interests to boost the healthy development of internet economy is the urgent problem facing us. In view of these facts, this essay based on the current phenomena of e-commerce will build a protection system for consumers' rights in e-commerce by analyzing arising problems. Hopefully, this essay can benefit the emerging e-commerce legislation concerning consumers' rights and protection.
