Land is mankind's survival of the most important resources, for farmers is the case with the closely related to land rights. The right of land can be said to be the core of the farmers' property rights. China's current building of a harmonious society lies in the basis of the construction of rural areas. The rural construction in the "political civilization" lies in the fundamental right of farmers. The establishment of peasant land rights and the protection of rural reform become the focus of the building. If not well established the basic rights of the farmers, the rural areas will not only affect the economic development, but also affect the coordination of the urban-rural relations and the long-term stability of China's economic growth. The goal of building a harmonious society will be beyond our reach. -China's system of collective land ownership, rooted in the socialist public ownership system. In a certain historical period, it had given Chinese farmers unprecedented enthusiasm of the labor. With the opening up and economic reform, collective land ownership system has gradually formed its own unique model. Today, even though China has established the basis of collective land ownership, the contract responsibility system for the main contents of the land use system, but the land system still exists of the shortcomings on the theory and content. In practice, it is difficult to reflect on the land fanners rights aspirations. Although the "People's Republic of China Property Law" offers further provisions, but the core of the theoretical circle dispute remains unresolved, and still can not meet the needs of the transformation on the collective land ownership system. Re-examine the system of collective land ownership, which we can not avoid, it is necessary to this issue in-depth study. It is not only related to the peasants' right to life, even related to China's economic development rate. It is a basic requirement of building a harmonious society. This paper retroact to the formation of the historical collective land ownership system, analyses the plight of the collective land ownership system, taps the root causes of their theoretical and practical shortcomings, and compares the pros and cons of various reform projects. Based on this, it proposes options, which the restructuring uses of. At the same time, it analyses the existing contract responsibility system and the plight of the defects on the basis of the feasibility of a proposed two modes of operation - the cooperative system and the shareholding system. China already has a law about the cooperative system. The paper analyses the pros and cons of the practice and learns from foreign experience to improve the views. Still in the theoretical study of the shareholding system, this paper presents specific building project.
