The Research Of Conflicts In Planning Legal System

Urban comprehensive planning and land use planning are two important plannings to guide a region urban construction and optimal land use structure. They are co-based on national ecnomy and society development program, co-taking land as brief planning object and co-taking rational exploitation , utilizing and pretection of land resources as the core content. So the two plannings should coordinate with each other. The differences of land classification and divisiory criterion, statistical definition, working method and technique measure between the two plannings have discovered , so the conflicts appeared.This paper consists that the conflict should be analyzed from the aspects of social background and system evolution. After the analysis of social background and system evolution, the author thinks that the essence of the conflict consists in the different legislation purpose, and the two are different system with different value orientation. The country paid different attention to impartial and efficiency in different urbanization periods.Firstly, the paper introduces the two strategic plans'purposes and tasks. And then the author analyses their connection and concludes that they should be coordinated and linked. The paper analyses the control indicators of the two strategic plans and concludes that the conflict reflects the conflict between population scale and urban construction using land scale.Secondly, the paper analyses the reason of the conflict that is the social background and system evolution. Based on this point the author finds the essence of the conflict. During the different periods of urbanization, the two existed in different social background, and they have different organization processes in different organization periods. The essence of the conflict is legislation purposes and value orientations. With the aspects of impartial and efficiency they have different attentions.Lastly, this paper discusses the connection of the two plans. One is how to connect them by law, and the other is what has been done in practice.
