The Research On FDI Legislation Issue Of Our Country

With the quick development of economic globalization, FDI (Foreign direct investment) has taken the place of the international trade to become the important impetus to promote the international economy. In the past 30 years of the reform and opening, we have got the great achievement in the economy and society. Especially when we entered the WTO, our country plays an active role in the allocation of resources of the international market and making the FDI.However, in contrast to the quick development of the FDI, the lag and the lack of the correlative legislation and research are evident. Therefore, how to strengthen the lawmaking and investigation of the FDI and form the substantial basis of the legal system of it becomes the urgent affairs. Considering this, from the construction of the jurisprudence to the enhancement and perfected of the regime of law, the writer puts forward some suggestions about the legislation of the FDI.Firstly, this article introduces some normal questions about the FDI, and presents the importance and availability of enhancing the FDI in China. Then, it consults the correlative legislation and policies of the western developed countries including Taiwan province, and the international laws and rules. At last, the article will analyze the law of the FDI and the existent problems in our country, which can help form the basis of the legal system of the FDI to encourage, protect and lead the foreign direct investment to a bright future.
