Researches On The Problem Of Released Juvenile Criminals' Recidivation

Recidivation is always regarded as a global problem. juvenile delinquency is a special type criminal. compared to adult criminals ,it has many different features in criminal type,social situation, family status and age structure. Therefore, it evokes more attention.Released Juvenile Criminals'Recidivation has many causes, and we can analyse it in different ways.Nowadays , the lag of current juvenile justice system and the lack of some efficiency institution brought many problems, include unbalance criminal liability to juvenile criminals, the abuse of short-time imprisonment and etc. These problems had a negative influence on the problem of Juvenile Criminals'Recidivation.The basic target of juvenile imprisonment is to prevent or decrease crime, but the shortcoming of imprisonment penalty, such as criminal infection, label effect, psychological unbalance, make the result of imprisonment quite depart from original purpose.After the release, Juvenile Criminals need the help from society and family to restart their life, but their own frangibility, inadaptability and distorted requirement had a direct influence on their process of resocialization.To deal with the problem of released juvenile criminals'recidivation, we must firstly revise our criminal laws, improve the system of juvenile penalty, complete the legislation about the reformatory, social education and imprisonment correction.In the case of juvenile delinquency , the court must analyze the causation of crime through general social investigation, increase the purposiveness of court education and the final judgment ,apply probation for fixed-term imprisonment as far as possible.During the imprisonment of juvenile, we should assemble the resource from all over the society, pay more attention to mental health education and through these measures, change the prison into a special school to juvenile criminals.After the release, family and society should respect and care them, use new ways to educate them, resolve their problems and create a favorable environment for their resocialization.
