Discussion Of The Construction Of Chinese Community Rectification System

Since the middle of 20th Century, especially in the recent twenty years, with the development of human culture, many countries in the worldwide continuously reform and innovate the criminal punishment system and try to punish the crime and convict in a most efficient, humanist and civilized manner. The community rectification is such a new punishment method created under this background.The community rectification is a punishment method opposite with imprisonment rectification. The community rectification is a non-imprisonment criminal execution method which means that the convict who meets the requirement of community rectification will be settled in the community and during the term made by the judgment, order or decision, the special state administration will rectify his criminal mentality and vile action and push the convict back to the society with the assistance of relevant social party, civil organization and the social volunteer. The community rectification system originated from Western countries as UK and USA and is an international trend of the loosing of the criminal punishment system. Such system makes a significant sense in promoting the convict back to the society, reducing the economic pressure on imprisonment, avoiding the crossing infection among the convicts, reasonably disposing the execution resources and promoting the healthy cycling of social security. Through studying on the definition, nature and academic base of the community rectification, this paper will consider the practice of community rectification in China and analyze the completion of necessary compound facilities of Chinese community rectification in respect of legislation institution, insurance and others. Furthermore, a countermeasure as a reference and advice will be brought forth to construct and promote such system in respect of the theory of criminal execution, consummation of legislation and the logistical thoughts.
