Contemporary Chinese Execution Socialization

Implementing the criminal judicial policy which combined with tolerance and strictness is the important topic which the judicial system reform faces in the new era. And socialization of execution is one indispensable important component part of the strict and tolerant criminal judicial policy. Regarding how to interpret socialization of execution essential meaning; how to correctly regard the advantage of the socialization of execution in our country; how to thorough analysis the lag reason of implementing socialization of execution in our country, as well as how to found the framework of socialization of execution in our country and so on, theoretically study about above problems is insufficiently mature, while the executions of each place are quiet different in the practice. The full text is divided into the introduction and three parts. The part of introduction was the outline, involving the define of the socialized concept, the connotation of socialization of execution and the present situation about socialization of execution and so on in contemporary China. The first part elaborated the advantage of socialization of execution in contemporary China and proposed more mature theory of socialization of execution which came from overseas, the domestic unceasingly in-depth research about socialization of execution, considerable success experience of socialization of execution practice and so on. It laid the foundation for implementing socialization of execution in our country, and provided the advantage. The second part analyzed the basic cause of the lag of socialization of execution from the influence of the following five aspects: traditional execution pattern, the present jail system, the social factor, the jail aspect factor, the criminal own and family factor. At the same time, this part analyzed the dangers of the lag of socialization of execution. The third part elaborated the framework of socialization of execution pattern from five aspects in our country. According to our country actual situation, it proposed that our country should further reform and improve the criminal classification treatment system and carry out open classification treatment system based on the system with the nature of socialization of execution. The system included affirmation parole, the suspension of sentence, and the control and so on. We should lay emphases on carrying out the community rectification system, enlarging the compatibility of the jail and society and strengthening protection of the person who leaves prison. At the same time, our country should grasp the criminal principle which combined with tolerance and strictness and pay great attention to the control of socialization of execution, thus construct socialization of execution system with the Chinese characteristic.This article is written to demonstrate the necessity of implementing socialization of execution as well as how to implement socialization of execution based on analyzing the advantage and lag reason of socialization of execution in our country. And clarified and analyzed several fuzzy questions such as the socialization of execution, classification treatment and the open classification treatment, community rectification, protection of the person who leaves prison and so on, thus proved the reality and feasibility of establishing the moderate open socialization of execution system in our country.
