Some Reflections On Personality And Crime

This paper mainly discusses the cause of crime, the prevention of crime and the correction of crime from the aspect of personality, and emphasizes particularly on the adolescent as the discussion object. The whole paper is mainly on the subject of personality and crime, discusses the problems on three aspects, and brings forward my own viewpoints, opinions and suggestions on each problem.I. The Relationship between Personality and CrimeBasically, the personality is composed of the seven aspects of characteristics. People's personality is the steady combination of seven kinds of on his body. Almost all the crimes are related to the personality. And the subjective reason of crime could not simply come down to which characteristic functions alone. In fact, the subjective reason system of crime is the state in which every characteristic contact with each other. Just because this certain contact corresponds with the certain external factors, the crime occurs.There are many studies on the research of the relationship between the characteristics of the personality and crime. This paper puts forward the concept of the characteristics of personality, and lists eight of them (idiocrasy, stability, the complete and unified nature, the reversed unity, complexity, changeability, elasticity, and maturity), and illustrates the meaning of every characteristic of personality and the relationship between it and crime.II. Personality and the Prevention of CrimeThe adolescent crime has already become the serious cosmopolitan society problem. Our country is not beyond the exception. The adolescent crime has become the serious problem. The reason for it is not only no descending trend of the proportion of the adolescent crime, but also the more apparent trend of the youth crime. While at the minority as the initial stage of life, once commit the crime, especially the educational correction is not to the core, one could do more harm to the person and the society. Therefore, the prevention of crime, and the study of crime should emphasize adolescent, in order to affect a permanent cure.From the aspect of personality, the prevention of crime has not got the deserved attention. This circumstance should be changed.The author thinks highly that it should do well in the prevention of the adolescent crime. The preferred best scheme is to care the protection and cultivation of personality of the adolescent in the all-directional aspects such as society, school, and family. The suggestions are to: revise the relevant law; found the special organization for the protection of the adolescent; found the school for parents to enhance their qualities; provide better food for thought for the adolescent, refine the surrounding environment of society, especially the school, clean up all pollution sources to poison the adolescent; strengthen the protection of the drop-outs, and the children of the problem family; put the quality education into effect, educate the talents and the people, and emphasize moral education; attach importance to the student ability education for adapting themselves to the society; think much of the value education such as the world outlook, outlook on life, the friendship point of view, the heroic point of view, sense of worth; use the right way for the teacher to criticize and educate.Next, the whole society should pay attention to the mental health of the adolescent. Strengthen the mental healthy education of the adolescent. It is suggested that the adolescent personality treatment organization should be set up in the school and the community, in which the adolescent who has the error personality could receive the mental consultant, and the correction of personality, to help them form the healthy personality and reduce the crime. The work of this organization should be paid attention to in the several points: first, it should extend the school correction and the society correction to the family. Because of the particularity of the family, most adolescent crimes are related to the families. Second, it must pay attention to the comprehensibility of the personality assessment and correction ways, because at present, none of the assessment and correction is the quite perfect way. Each way has its limitation and complementarity. Therefore, they should be used comprehensively. The third, it must pay attention to the longitudinal way of the personality assessment and correction, which is determined by the characteristics of the personality. Fourth, it must pay attention to the situation of the personality assessment and correction. Therefore, the personality is the result of adapting to the environment. Fifth, it firmly prevents the negative label effect. Therefore, the mental mind of the adolescent has been weak, which could produce the self-identity.III. The Correction of criminal personalityFirst, it brings forward the concept of the correction of the criminal personality. The theoretical circle has the different understanding of the connotation and the application scope of the mental correction. It could be divided into two kinds of comprehension in the narrow and broad senses. However, the practical handling of the definitions of the narrow and broad senses has the inconvenient circumstance. According to the situation of our country and the traditional experiences of the prison work, it is more proper to adopt the quasi-generalized concept of the criminal mental correction. For this significance, the criminal mental correction is a means that the prison organization applies the principle of the psychology, adopts psychological consultation and the methods and technology of the mental correction to help the criminals overcome the mental obstacles and the psychological problems which occur during the period of serving his sentence, in order to make the mental quality of the criminals turn good, and form the healthy personality which is good for stabilizing the transformation order and advancing the transformation quality. It includes many aspects such as the psychological test, the psychological consultation, the psychological treatment and the psychological health education.Next, it brings forward the problems of the correction of the criminal personality in four aspects which needs the urgent solutions, and proposes the solutions: first, it is the correction theory and the localization of the correction methods. The present correction theory and correction methods are all introduced. The development of Chinese culture has the long-term nature, the closure nature and continuity, and forms its own special national characters. If it only copies and uses the introduced methods from abroad, it is not accepted. It must develop the localized correction theory and correction methods. This is the urgent thing at present. Second, it is to build up the qualified the files for the criminal psychology. They are the bases for the criminal transformation, the assessment for the criminal psychology and correction, and the following education after the criminals' return to the society. It is obvious that its scientific nature and perfect property are very important. Therefore, in the personality test, it must emphasize the credibility. The operation should be scientifically strict. And it makes the great effort to draw the scientific conclusion combining other methods for the personality assessment. Third, it should establish the professional team of high-quality. The eligible professional team is the necessary resources guarantee for the correction of the criminal personality. But according to the present situation, it is far for enough only to depend on the short-term training of the in-service policemen. It must realize specialization and profession of the team for the criminal personality. For these, the relevant laws and regulations have the provisions. At present, the keystone is to carry out it. Fourth, it extends the correction work into the detention house. The detention house is the blind area of the assessment for the criminal psychology and the mental correction. The practice and the investigation questionnaires all prove that, it is essential to found the organization of the mental correction, equip with the special staff, and carry through the classified correction.
