Research On The Crime Of Fraud By Using Credit Card

In recent years, the Credit Card market in China has a huge development. It brings prosperity to our financial industry, and also changes our life everyday. However, on the other hand, percentage of criminal activities by using Credit Card has increased. In this thesis, I will do some Research on the crime by using Credit Card. Firstly I will introduce the development history of the Credit Card. Secondly, I will point out the definition of the Credit Card in the Criminal Law. Then, I will analyze each kind of crime situation by using Credit card. Finally, I will give some my own opinions about penalties of the Credit Card Fraud and the improvement of legislation and judicatory.There are five parts in the thesis.Chapter I introduced the development history of the Credit Card and its definition in Criminal Law. Then I introduced the definition of Fraud crime by using Credit Card and introduced the damage to our society. This chapter also introduced the tendency of this crime.Chapter II focused on the constitution of crime. In this part it introduced the character of this crime, and introduced the modes about the Fraud crime by using Credit Card.Chapter III focused on how to judge about this crime, example how to tell this crime to another crime, and in what condition someone is criminal when he used credit card. It also researched on the suspended situation of the crime, joint crimes, and the form of quantity of crime in this part.Chapter IV focused on the measurement of punishments. It is very important to fix punishments on the crime that how to define the amount of the Fraud crime by using Credit Card.Chapter V focused on the legislation and the justice of the charge. In this part it studied the legislation and the justice in china and other country. And it also given some advices for the legislation and the justice about this Fraud crime.
