The Study On The Legal System Of Scientific And Technological Achievements Transformation

Along with the arrival of knowledge-based economy ages, the growth of economy more and more depends on the progress of science and technology. Almost all the countries in the world have adopted various measures to promote transformation of achievements of S&T for the sake of its economy development. Because the transformation of science and technology itself is complex and has high risk, its impact factors are also various, among which the function of the exterior law system is particularly obvious.This paper mainly focus on the establishment of exterior law system of S&T transformation, try to systemically analyze the mechanism of transformation of achievements of S&T, from the view of law. By analyzing the current laws in China, this paper points out the existed problems in the laws about S&T achievement conversion in China, including the rights and obligations of the subject is not clear, the originality belonging of object is not definite, the lack of a necessary evaluation system and the incompleteness of guarantee system, and other problems. In addition, the paper, on the basis of these analyses introduces international lawmaking experience of S&T achievements converting, and further put forward suggestions to consummate the science and technology result conversion law system in China.
