Study On The Distribution System Of Rights And Interests In The Transformation Of Agricultural Science And Technology Achievements

The achievement of agricultural sci-tech is an important strategic resource to strengthen the independent innovation of Agriculture in China.Transformation of Agricultural sci-tech achievements is the key to accelerate the transformation and development of China's Agriculture.However,the current technology transfer rate of agricultural sci-tech achievements in our country is not high;and this is mainly due to the formation of a reasonable distribution of rights and interests caused by the system.Therefore,the thought of this thesis is: background—literature review—theoretical discussion—theory support—policy combing and status investigation—empirical analysis—sound system—perfect mechanism technology path,depth analysis of the allocation of rights and interests of agricultural sci-tech achievements.First of all,the study will use macro-control theory of law,balance of interests theory,and cooperative game theory in Economics and Public product theory to depth analysis the allocation of rights and interests of Agricultural sci-tech achievements.Especially to explain the concept of agricultural sci-tech achievements ?composition and distribution of rights in the transformation of agricultural sci-technology achievements.And provide the theoretical basis for the perfection of the rights and interests distribution system of agricultural sci-tech achievements.Then,the author uses the perspective of comparative law to discuss the legislation and practice of the distribution of rights and interests of agricultural scientific and technological achievements in the typical developed countries.The legislation and practice of the distribution of rights and interests of agricultural sci-tech achievements in the United States,Japan and Germany show that equity distribution system,reasonable scientific and technological achievements titling rules and the principle of benefit distribution in autonomy can provide reference experience.Next,the author combines the laws and regulations related to the distribution of rights and interests of agricultural science and technology achievements in China.Taking Hu bei Province as an example,the author aims to investigate the status quo of the implementation of the system.Agricultural sci-tech Achievement transformation Rights Distribution System of our country present that laws and regulations related to the equity allocation is not perfect ? the principle of attribution of scientific and technologicalachievements is too single;scientific and technological achievements profit sharing arrangement is not perfect;benefit-content is imperfect,the coordination and monitoring mechanisms are lack of and the risk sharing and safeguard mechanism of sci-tech achievements are not perfect.Finally,in order to play the role of equity distribution system for the transformation of sci-tech achievements,our country should be the balance of interests,risk sharing and distribution of benefits to match the principle,establish and improve the implementation of policies by the relevant legislation and supporting,improve the system of agricultural scientific and technological achievements property ownership,optimize the Benefit Distribution System for the Transformation of sci-tech achievements,construction of technological achievements into risk-sharing and security system Etc to improve the conversion rights of the distribution system Agricultural Science and Technology Achievements in China.At the same time,in order to ensure the good operation of the system,construct long-term endogenous mechanism,supervise and coordinate mechanism and collaborate safeguards mechanism should be work together to crack the problem of agricultural sci-tech achievements of agriculture,promoting the transformation of agricultural sci-tech achievements.
