The Research On Legal Matter Of Electric Power Trade's Marketization

More than 20 years' reformation of economic structure, the system of Planned-Economy what was highly concentrated had been destroyed, it makes Chinese competitive industries to interim to the Market System of Socialism. However, the electric power trade is working in a very low efficiency during the industries which have natural monologue character. It is showed that 1/6 state-owned property is concentrated on electric power trade(about 800 billions), every year, the investment of fixed assets in electric power trade are 16% of these to the whole country, some years more than 18%. But in 1999, the part of the profits turned over to the state only 8.6 billions, for example, 9.6 billions in 2001. Now, in one hand, the electric power trade gets the monologue from the government, so it makes the irregular income; in the other hand, the profits of consumer can't be protected in deed, even be destroyed.As a basic,principle,strategic part, every government in the world makes the law to control the electric power trade in order to make sure the resources can be divided effectively. So, the developed countries are doing the reform of electric power trade one by one, it also makes this part to improve and give the experience to the reformation. Our state always tries its best to inquire into the way to the reformation.In our daily theory part, electric power trade marketization's pattern is insufficient, especially in the research on marketization's pattern; in practice, Electric Power Law is so lagged that the market can not be controlled by the government, and at the same time , it also can't be divided clearly. Therefore, how to involve the problems during the reformation of electric power trade marketization has been the most important thing.This thesis can be divided into four parts:The first chapter is the analysis of electric power trade's present situation. It starts with the connotation, and then, gives the aim,principle and fundamental mentality to reformation of electric power trade's marketization. The second chapter is the legal problems to electric power trade's body. It centers on British and American pattern of electric power trade's marketization, and gives the selection of pattern to our country's electric power trade's marketization.The third chapter is starting with the supervision of responsible institution of British and American electrical market, during compare with these two countries, gives the supervision of responsible institution of our country's electrical market.The forth chapter is the accomplishment to legal system of electric power trade's marketization, during the analysis, gives the accomplishment to the Anti-Unethical Competition Law,Electric Power Law and Price Law.My thesis uses the way of theory analysis,reality research,profit analysis,compared research to analyzing the theory of the pattern of electric power trade' s marketization, and analyzes the practices to law of abroad and domestic in order to accomplish our legal system of electric power trade's marketization, gives the protection to our electric power trade' s marketization.
