Since the promulgation of"Land Management Law of the People's Republic of China"in 1998, the paid use system of state-owned land has been formally established and popularized. This is a significant landmark in the history of the land management in our country. Combined with the basic situation of our country and the general social systems, the remising-land system, which is a reform of the paid use system of state-owned land, is said to be a pioneer-work of the land system history of human being. It has been proved that the implementation of the system broke the traditional mode of gratuitous granting-land which had been formed under the planed economic system. On the basis of successful separation between the ownership and usufruct of the state-owned land, the institution plays an important role in promoting the rational use of state-owned land, protecting the cultivated land and increasing the national finance. Without a precedent to follow, however, many theoretical and practical problems of the system are still being explored and summarized. Quite a few unexpected problems have occurred during the process of the implementation of the institution, bringing about some obstacles and difficulties in the management of remising-land and giving rise to some abuses of our remising-land market, which call for urgent solution and regulation.The blemish on the system comes from the shortage of the theoretical knowledge; the problems in practice reflect the necessity and pressure of innovation in institution. In order to make the brand-new system more lifeful and active, it's now quite necessary to make a profound reflection of the system itself, finding out the existing problems and trying to improve it. Therefore, this paper, setting out from practical demand, focuses on the study of a series of issues relating to our remising-land system and market, and points out the importance of strengthening the macroscopic readjustment and control of our remising-land market. It's designed to raise our theoretical awareness and offer some new thoughts on realizing the standardization and market-run of the system, the more reasonable collocation of land resource and the protection of land. It also aims to provide some advisable reference to further improve our urban land use institution, regulate government's behavior during land-remising, strengthen the macroscopic control of the remising-land market and promote the sustainable development of the land market.
