The Research On Legal System Of Supervision Of Market Access Of Foreign Insurance Company

With the development of globalization and liberalization of insurance service, the role and influence of foreign insurance companies have been gradually promoted. With the social and publicity, and in order to safeguard the safety and stabilization of native insurance, the vast majority of countries have strengthened the supervision on market access of foreign insurance in the world. We should strengthen the supervision of market access for foreign insurance companies to security the quality of foreign insurance companies, reduce and avoid the risk of insurance market, it could ensure the stability of China's financial market and the healthy development of national economy. Basing on the WTO′s relevant request and China′s agreement about the opening of insurance, our country must perfect our country′s supervision and its legal system on market access of foreign insurance organizations. The author gives some useful suggestions to perfect our country′s supervision and its legal system on market access of foreign insurance organization.This thesis includes three parts, including introduction, text and conclusion. And the text part is divided into four parts.Chapter 1, the necessity and theories of the admittance of foreign insurance company. We will begin with discussing the meaning of the admittance of foreign insurance company and analyze the necessity of it according to the particularity of insurance. Based on these, the principles and arrangements of system of admittance of foreign insurance company are further elaborated.Chapter 2, the international legislation about the admittance of foreign insurance company. As the financial market develops internationally, the admittance of foreign insurance company supervising is not only rely on domestic supervising, but also need the international cooperation. The international conventions of WTO and International Association of Insurance Supervisor are the most important about foreign insurance company. In this chapter, first introduces the GATS and its appendix. Then analyze the laws of International Association of Insurance Supervisor.Chapter 3, the domestic legislation analyzes about the admittance of foreign insurance company. Firstly, we discuss the principles of the admittance of foreign insurance company which includes the most-favored nation treatment and citizen treatment etc. Secondly, compares the open mode of the development countries with the developing countries. Lastly, introducing management qualifications, management ability, property condition about the admittance of foreign insurance company.Chapter 4, making the law system of admittance of foreign insurance company of our country perfect. First, make a brief introduction of the promises of the world insurance service and trade of our country. Second, analyze the admittance system of our country. In the end, appraise the admittance system of our country, and give suggestions about how to improve our law system of the admittance of the foreign insurance companies.
