Market Access Of Foreign Insurance Institutions Regulatory Legal System Research

With the development of global ization and liberalization of insurance services, the role and influence of foreign insurance organizations have been gradually promoted. Meanwhile there are more and more market access rules for foreign insurance organizations in many countries' insurance laws . Insurance has a great effect on national society and economy.In order to prevent foreign capital from impacting and penetrating excessively on the native insurance, the safety and stabilization of native insurance, the vast majority of countries have strengthened the supervision on market access foreign insurance in the world. Basing on the WTO's relevant request and China's agreement about the opening of insurance, our country must perfect our country's supervision and its legal system on market access of foreign insurance organizations. The author gives some useful suggestions to perfect our country's supervision and its legal system on market access of foreign insurance organization.The thesis consists of 38,000 words in 5 sections.Section I introduces theories of supervision on market access of foreign insurance , the necessity and objects of regulating market access .On the analysis of four kinds of legal arrangement for foreign insurance organizations supervision, Section II discusses characteristics of four kinds of legal arrangement for foreign insurance organizations supervision and do some explanation about it by giving some examples of Japan, Chile, South Africa and Malaysia.Section TIT focuses on legislation structure and specificrules of the host supervision over foreign insurance organizations. The thesis pays more attention to the supervisory issues, such as establishment of organizations and business license, and the limitation for establishment, holding shares, scope of business, location for operations.Many countries have thought of cooperation of supervision over fore i gn i nsurance organ i zat i ons.It is undoubted that the effective supervision on foreign insurance organizations demands bilateral and multilateral cooperation. Some achievements were reached on the system of WTO ,EU and IAIS. Section IV introduces and reviews market access rules of the legal documents of WTO, EU, and IAIS.Section V ana lysis China' s agreement about the opening of insurance, and China' s legislation on supervision on market access of f ore i gn i nsurance organ i zat i ons. On the bas i s of foregoing studies, the author studies the issues and countermeasures of foreign insurance organizations market access system in China.
