Study Of Market Access Of Foreign Insurance Companies, Regulatory Legal Issues

With the development of globalization and liberalization of insurance services, the role and influence of foreign insurance companies have been gradually promoted. Meanwhile there are more and more market access rules for foreign insurance companies in many countries' insurance laws .Insurance has a great effect on national society and economy .In order to prevent foreign capital from impacting and penetrating excessively on the native insurance, the safety and stabilization of native insurance, the vast majority of countries have strengthened the supervision on market access foreign insurance in the world. Basing on the WTO's relevant request and China's agreement about the opening of insurance, our country must perfect our country's supervision and its legal system on market access of foreign insurance companies. The author gives some useful suggestions to perfect our country's supervision and its legal system on market access of foreign insurance companies.The thesis consists of more than 40 thousand with four chapters.The first selection of the thesis introduces the theorial background of the insurance market access.This chapter mainly falls into two parts:the reason for market access surpervision is analysed on the basis of economics and law value.In the second chapter, I list what elements are generally to be considered, including supervision mode, access principle and specialized regulations, getting acquaint with the system frame on the whole.In the third chapter, the methods of comparison and analyze is used for us to learn from those countries, areas or international organizations which have had rich experience in insurance market supervision,such as WTO,America, EU,Korea and our Taiwan area.Finally, with our undertaking for WTO entry, some evaluation and suggestion is put forward on the relevant legislation of market access supervision for our foreign insurance companies.
