Research On Criminal Law Legislation Of Juvenile Delinquency

In recent years, juvenile delinquency has already become a universal and serious social problem all over the world. For a long time, the frequency of juvenile delinquency in China has remained high and has been one of the most important social problems that influenced the stability of the country and the development of the economy. Although many scholars have spared no effort to research on the problem, and achieved series of important academic accomplishments which are practically significant, generally speaking , few researches on this topic are conducted from the perspective of criminal law. Based on the previous researches made by the experts all over the world, this thesis is, by analyzing the regulations of juvenile delinquency of the criminal law, value inclination and existing problems of juveniles, devoted to propose legislate a substantive criminal law concerning juvenile delinquency with the purpose of preventing and reducing juvenile crimes.This thesis is divided into five parts, with about 40 thousand words. More details are provided as follows:Chapter One is the summarization on legislation of the juvenile delinquency in our country. It is the introduction of the legislation evolution and the present regulation on juvenile delinquency in our country. Meanwhile, it defines "juvenile" and "juvenile delinquency".Chapter Two is the summarization on legislation of the juvenile delinquency in other countries. It is the introduction of the main features of the juvenile delinquency on the overseas juvenile law and the international convention of the United Nations, thus revealing the disparity of our country and the overseas developed country.Chapter Three is the value inclination of the legislation of crinimal law on juvenile delinquency in our country. We will first reason out the value inclination of the criminal law from the function, the nature and the purpose of penalty and then by combining the special physiological and psychological characteristics of juveniles with and the judicial interpretation of the criminal law, conclude the value inclination of the legislation of crinimal law on juvenile delinquency in our country.Chapter Four is the analysis of the legislation problems on juvenile delinquency in criminal law in our country. This chapter, from the perspective of legislation style, criminal liability, and penalty, points out the problems and insufficiency of on the regulation of juvenile delinquency in criminal law of our country.Chapter Five is the suggestion of how to perfect the legislation on juvenile delinquency. This is the key part of the thesis, which, in relation to the problems discussed in Chapter four concerning the regulation of juvenile delinquency in criminal law, proposes detailed suggestions on how to perfect the legislation, from the perspective of legislation style, criminal liability, and penalty.The author, with this thesis, hopes to reflect and probe into the problem of juvenile delinquency.
