The Legal Study Of Government Procurement Influenced By The Economic Globalization

Economic Globalization is a concept that has been internationally quoted more and more frequently in recent years. It means the deepening of the degree of economic opening, mutual relying and globalization. Government Procurement Policy is an essential part of economic globalization. Government Procurement Policy is founded and perfected with the transition of public function of the municipal government. Thus we must understand thoroughly the general situation of the Government Procurement Policy of the advanced countries and regions and international government procurement policy first in order to understand the motivation and its content and the relevance between them of the law of government procurement.In the late 70s of the twentieth century, most countries have reached the Government Procurement Agreement in the multi-lateral Trade Negotiation in Tokyo Round in the General Agreement on Tariffs and Trade, which agreed to open the purchasing activities conducted by the departments of the central government. Since the conducting scope of the GPA is rather limited, these countries held another trade negotiation on government procurement in Uruguay Round. They signed a new GPA in Marrakech in 1994. And also on 8th December, 2006, the Government Procurement Committee of WTO passed the revised version of GPA temporarily .Although this GPA is still a volunteer multi-lateral agreement, it will be accepted by the Umbrella Agreement of WTO and finally becomes part of Multi-lateral Agreement in the long run.The Law of Government Procurement of PRC was passed at the Twenty-eighth of the Ninth National People's Congress in June, 2002. it became valid from 1st Jan., 2003. It is a very important law that regulates the government procurement activities. After the pilot undertaking of government procurement conducted from 1996, the government procurement scope and the capital have been rapidly enlarging. Under this circumstance, the issue of the Law of Government Procurement is rather necessary. At the same time , it is significant in helping the rapid and healthy development of government procurement activities. China is a member of WTO, Joining the GPA and opening the government procurement market is very necessary. In this essay, I will begin with the concept, characteristic and its development of government procurement, and try to introduce and compare the government procurement policy in our country and the advanced countries and regions in the world and GPA of WTO, and thus illustrate how to perfect the government procurement policy in our country under the circumstance of economic globalization.
