Study On The Charging Right Of International Shipping Carrier Through Taking THC

The international shipping carrier is one of important subject in ocean transportation and takes great part in the transportation. Although this, we don't pay enough attention to the charging right of carrier. From 2002, the international shipping carriers have been taking THC in ports of China. The action has made a great discussion, even the government departments join the investigation about this charges. This dissertation analyzes taking of THC in our country and focuses on legal problems, then proposes the matters in the present legal system and tries to resolve them.Besides Preface and Conclusion, this dissertation is divided into 3 chapters as follows:Chapter 1 firstly reviews the starting of THC, including the concept, the disputes, the legal character of THC, the relationship between THC and the international shipping carriers'right to take charges. The fees which charged by international shipping carriers is divided in two parts: one is ocean freight, the other one is other fees except the ocean freight. THC produced in terminal service belongs to the latter one.Chapter 2 focuses on the charging of THC, including its legal validity, rationality and reality. THC exists in the container handling at terminals. This chapter analyses legal validity from two aspects: internal law and international law, then expatiates on the reality of THC.Chapter 3 studies the legal problems in the system of taking charges for international shipping carrier. Find the deficiency in present legal system, gives suggestion to improve the legal system based on chapter 1 and chapter 2.
