The Trust Law of PRC symbolizes the new stage in the development process of Chinese public industry, which has made principal stipulations about public trust (charitable trust). Nowadays, commonweal is paid more attention to by the government media and people. Therefore, it is vitally important that how to consummate the system of public trust in order that it is combined with the public good or welfare. Under this circumstance, exertion of public trust system seems especially in order to make the most use of people and enterprises' donations. Therefore, in this context, the author focused the study on the charitable trust in the academic perspective of law.The thesis includes three parts: The first part mainly introduces essential theory about trust and charitable trust. The following is such as: concept, origin, legal relation, category and its characteristics and etc. What's more, the author makes a comparison between the public trust and the public parties, pointing out their own specialties and distinctions.The second part analyzed the legislation of charitable trust and its practice of development. Taking Japan and England as examples, the author analyzes two countries' public trust system like public trust supervisor and revenue system. Meantime, on the basis of analysis of our country's legislative trust system, the author found out the disadvantages of this issue and the reasons of problems.The third part refers to suggestions about improving and completing our country's charitable trust system. Beginning with the significance and necessary of the public trust, it is suggested that our country take Anglo-American Law System use for reference. The fund unions in our country can develop public good and welfare in the form of the public trust. The author has made some suggestions on restructuring the framework of the charitable trust in order to promote the development of the commonweal affairs.
